Requirements For Eligibility This application is for the casting of both, a reality based internet and television show currently entitled “April” and for the chosen applicant(s) to appear in television advertisements for services provided by Uncle Magic, The Hip Hop Magician of Alakazam, Inc. (collectively, the “Program”), both of which are being produced solely for entertainment purposes. The Program is being produced by FM Studios, Inc. and Alakazam, Inc. (collectively “Producers”) and the television advertisements will air on the WPIX â€“ 11 Network in New York and its surrounding areas, as well as, on cable television. The following eligibility requirements must be met in order to proceed with the application process: 1. You must be a legal resident of the United States. 2. You must be at least 18 years of age to qualify as "Auntie Magic" or obtain Parental consent to qualify as "Kid Magic". 3. You must either reside in the New York City tri-state area or areas in which WPIX-11 regularly airs including but not limited to New Jersey, Connecticut, Philadelphia, PA and surrounding suburbs, and applicable areas of Boston, MA. You must Provide at least a headshot of yourself. 4. You must provide a twenty-five ($25) dollar non-refundable application fee in the form of a certified check or money order. Personal checks will be returned. DON NOT SEND CASH to satisfy the application fee. Payment shall be made payable Alakazam, Inc. and sent to Alakazam, Inc. 1510 Castle Hill Avenue, Suite 335, Bronx, New York 10462. 5. You must now be a candidate for a public office of any kind, and you herein agree to not become a candidate for public office at least one (1) year after initial broadcasts of all programs in which you appear. 6. You must not have appeared as a participant on more than two (2) other Internet based shows within the previous two (2) years from the tape date of the initial episode in which you will appear. 7. If you are selected for an interview or move further along in the consideration process to become a Program Participant, you may be required to complete additional applications, releases or eligibility forms as Producers see fit. 8. If you are selected as a Program Participant, you must agree without reservation for Producers to visit your home and/or place of business for approximately three (3) hours for the purpose of conducting an interview at producersâ€™ sole discretion. 9. Being chosen to interview at any level will not ensure that you will be selected to continue through the selection process. Producers reserve the right to disqualify or exclude, at their sole discretion, any individual form the interview and selection process at any time. Producers also reserve the right to change the rules and producers at any time. Application Release I hereby acknowledge that I have read, understood and meet the eligibility requirements. I hereby certify, represent and warrant that all statements made in this application are true and complete. I understand that if any of the disclosures made by me on this application are false, this will be cause for disqualification of my consideration for this production. I further acknowledge and accept that this application form and any other materials (including, but not limited to, photographs, biographical information and/or personal information) (collectively, â€œMaterialâ€) I have submitted or will submit to Producers, shall become the sole and exclusive property of Producers and will not be returned to me. I understand that as owners of this Material, Producers shall become the sole and exclusive property of Producers and will not be returned to me. I understand that as owners of this Material, Producers shall have the perpetual, irrevocable and unencumbered right (but not the obligation) to edit, distribute and exploit the Material submitted in any manner in their sole discretion but shall have no obligation to do so. By signing below, I grant FM Studios, Inc. and/or Alakazam, Inc., the perpetual, irrevocable and unencumbered right but not the obligation to use any of the material contained in this application, and to publicize said Material, including my voice, actions, likeness and appearance in any manner in connection with this production. I understand that Producers may assign or transfer the rights granted herein to any third party(ies) in Producersâ€™ sole discretion. I hereby release and indemnify FM Studios, Inc., WPIX-11 New York, Alakazam, Inc. and all of their respective licenses, assigns, successors, parents, affiliated and subsidiary companies, divisions, and joint ventures, as well as, their employees, officers, directors and agents (collectively, "Released Parties") from any and all claims, demands of every kind that I or any third party may now or hereafter have or may have against the Released Parties in connection with my application to appear in the Program and the exploitation of any and all Material I have submitted or may submit in connection therewith, including but not limited to, any video taped images of me taken at my home and/or place of business, or any exercise by any or all of the released parties of any of the rights I am granting hereunder, or any other matter contained herein, including but not limited any claims for defamation, violation of rights of privacy and/or publicity, negligence, fraud, international infliction of emotional distress. Finally, I understand that the rights and Material granted to Producers and/or waived by me through this release shall not be diminished or in any way affected by the fact that Producers did not select me as a participant on the Program. In signing this Release, I have not relied on any representations or other statements that are not contained herein. No promises have been made to me other than as set forth herein, if any. I understand and agree that no oral agreements are binding. This Release sets forth the entire agreement between me and Producers with respect to the subject matter hereof and may not be altered, amended or modified except in writing signed by both parties.
